I admit it's a great legal move by the club, they found a loophole in the legal code.
BUT
fielding Neymar tomorrow at Bernabeu means automatic 0-3 win for Real Madrid. There is no way the the Spanish Sports Tribunal (TAD) will overturn FEF's 3 match ban. I have few explanations why we are doing this:
1) Neymar won't play, it's part of the prematch mind-games.
2) Could be a smear campaign. If we win tomorrow night with Neymar on the pitch, TAD keeps Neymar's ban 100% certain, it's 3 points for Real Madrid. They win La Liga, right... but it's the most controversial title in Madrid's recent history. Given the events from Tuesday night, Viktor Kassai's MOTM performance against Bayern Munich, it will be another big blow on their sportsmanship, which they try so hard to pretend.
