If we were going strictly by peak performance during a year:

Ballon D'Or CLEARLY goes to Messi in 2009, 2011, 2012, 2015, 2019. 2021 and 2010 are arguable (I would personally give it to Xavi for 2010)

Ballon D'Or CLEARLY goes to CR7 in 2008, 2014, 2017. 2013, 2016, 2018 are arguable (I would personally give it to Ribery or Robben for 2013 due to treble +performances but CR7 was right up there individually on performances. Messi was unfortunately injured or he would be here too)

So, it's 5 definitely + maybe 2 vs. 3 definitely + maybe 3.

I think the tally as it stands reflects the "truth"... which is Messi being better than CR7 but not by a huge margin.
