This isn't a "rule" that needs to be changed, it's a European Union law and the EU has shown before that it doesn't give a damn if its laws screw up football (i.e. Bosman)

Or they just underestimated the effects of bosman and do give in to the lobby work of Uefa. check the pending Lisbon treaty, sports will be exempted from teh freedom of movement for workers. so we need to wait till that gets ratified, who knows we really might see some change.

bosman is just how the ECJ filled in the meaning of the rules, the rules itself can easily change with that new basis.
