6+5 is basically racism ,or sectarianism whatever you wanna call it, so I'm against it.

Does it discriminate on race? No, so it's not racism. Does it discriminate on religion? No, so it's not sectarianism. It may be nationalism but forging a stronger identity for domestic leagues through ensuring that sides represent local talent is no bad thing IMO.

Or they just underestimated the effects of bosman and do give in to the lobby work of Uefa. check the pending Lisbon treaty, sports will be exempted from teh freedom of movement for workers. so we need to wait till that gets ratified, who knows we really might see some change.

bosman is just how the ECJ filled in the meaning of the rules, the rules itself can easily change with that new basis.

You have to remember that Lisbon treaty in itself may as well be amended several times, depending on the pressure lobbying groups are willing to put onto it. Ther have been also talks of setting up an independent body being a part of EU concentrating on footballing aspects.

However, the thing is that even though sports would be exempted from the Lisbon Treaty, which to some extent is controversial towards the Article 36 of the Rome Treaty (freedom of movement of persons, goods, workers), it wouldn only mean that EU could regulate sporting aspects including bans on contracts made with under-18 year olds.

Remember, that Ireland is having its second referendum on 2nd of October and it still might not fly. Czech senators have voiced their concern over certain legal technical aspects and are now gathering people to vote anew - yet it is unlikely to happen. Notwithstanding, I wouldn't see it as an ultimately bad thing and as I've mentioned before it will most likely be amended by a new improved treaty if overwhelming controversies arise.

Sports wouldn't be exempted from the lisbon treaty, it gets a special place to separate it from the economic consequences of the treaty/judgments/... and what has Art 36 EC to do with it? I cannot relate anything of that article (original or renumbered) to sports.

Ireland will agree, i feel they are somehow morally obliged to do that. it's a country that really enjoyed a lot of EU subsidies to grow and grow so they owe the Eu something. in Germany, the claim for unconstitutionality has been ruled negatively so no problem there anymore. Czechs ....... yeah, i'm not really fan of their policy/politicians but we'll see.

i wouldn't really where the controversies would all come from. this new treaty is basically the same as the one in place now, just a few adjustments. i bet more than 90% is already installed at this point in time. the biggest obstacle is that it was called constitution, it gave people the creeps for some reason.

Oops, my mistake. I meant Art. 39 of course. But yeah, new provisions will enable the EU to support, coordinate and supplement the actions of its Member States in regards to sport as a whole.

The problem is that media and mostly people that don't know what the Treaty is about (which is practically almost 90%, if not more) exaggerate its affects and blow it way out of its proportions. The Lisbon Treaty is pretty much just an amendment (or an update) on the treaty of Nice.

ps. Regarding Czech Republic - man, their Eu presidency for the last six months has been an utter disaster. Hopefully Sweden does a better job.

to be precise: 39 is only about workers, not persons and goods. :p



nor is a 6+5 rule (as in homegrown players + bought players) based on nationality. Imagine twin brothers, both born in andalucia, are joining football teams. one joins Real (that's the stupid twin brother) and the other barcelona (this is the twin brother that has everything life could possibly give him. both cannot play for the other team as a 'home grown player' albeit the two share the exact same genes.

it is based on "(the place of) qualification" so to say, but yeah, even that isn't really allowed. so that's why sports are willing to be excluded from normal economic professions.

Don't forget it has already been done. national football teams can use nationality discrimination. Why? because the ECJ just excluded them from the normal economic professions, stating that it had a 'social character' and people don't play for their country for money but for the honour. Maybe, but i believe reaching a quarter final on a WC won't leave you in the dressing room just with the honour. you'll get a nice monetary bonus. I agree it's different from club football, but it's certainly not a world of difference.

Gnegs: Yeah, kind of mixed up there too. Basically I meant to emphasize the freedom of workers and while writing that down I had EC Law's 2nd edition under my nose. Too much of everything all at once :-D.

Well, those are "refreshing" note from our EU member...:D

I don't live in EU so i don't really understand at first, but after reading all those explanation, i quite get the picture.

If it's about rule and constitution, it's going to be hard to put 6+5 rules. I definitely vote for "6+5". Cause everything, espeecially football, must not forget their roots. I don't know with you guys, for me is good to see my team sign someone to lift my team and to be a hero, but it will definitely give more happiness and pleasure for me to see a local hero play for your team and lift your team. I don't know in barcelona, but if messi play in my team, the story about how he joined the club will be a folklore and to be told to my son and my grandson in the future before their going to bed.

He's back training, as I'm sure you know. Sport are reporting that he wants to take part, I wouldn't rule it out. Would be great if he does.
