from what i remember hearing the head of the spanish tax service (the one that is pushing for Messi to appear in court) is a former Real Madrid board-member, so tax service not memeber of the court

They all had to appear in court. Xabi Alonso supposedly evaded the same amount as Masche, but you hardly see stuff about it. Messi will stand trial because of de Lapuerta. His case is being treated differently from the start.
